New Zealand Expands Open Work Rights for Partners of Migrant Workers

The New Zealand government has announced new measures to grant open work rights to more partners of migrant workers, aimed at keeping families together while addressing skill shortages in critical sectors. Starting from 2 December 2024, these changes will enable partners of migrant workers to work for any employer across the country.

Who is eligible?

  • Partners of Accredited Employer Work Visa (AEWV) holders working in ANZSCO Level 1-3 roles and earning at least NZD 25.29/hour.
  • Partners of AEWV holders earning at least $25.29/hour who were already supporting a partner’s work visa as of 26 June 2024.
  • Partners of Essential Skills visa holders earn at least $25.29/hour.

For AEWV holders in ANZSCO Level 4-5 roles, open work rights will also be extended if they meet any of the following criteria:

  • Earn at least $47.41/hour (150% of the median wage).
  • Earn at least $31.61/hour in a role on the Green List and meet the associated requirements.
  • Earn at least $25.29/hour and work in the Transport or Care Sector Agreements, or earn the wage specified in the sector agreement.

The Australian and New Zealand Standard Classification of Occupations (ANZSCO) grades occupations from Level 1 (high-skilled) to Level 5 (less skilled). These changes ensure that partners in various skilled sectors, including those in lower-level occupations, have greater flexibility in the workforce.

Next Steps: Starting 2 December 2024, eligible partners can apply for a variation of conditions or a new work visa to gain open work rights.
