USCIS announces final rule to strengthen integrity and reduce fraud in the H-1B registration process. It includes a beneficiary-centric selection process, passport/travel document requirements, and start date flexibility for certain petitions.
USCIS clarifies requirements for requested employment start dates and codifies the ability to deny or revoke H-1B petitions based on false attestation or invalid registration.
The Fee Schedule final rule will go into effect after the initial registration period for FY 2025, keeping the registration fee at $10. A new edition of Form I-129 with rule changes will be available on uscis.gov from April 1, 2024.
The initial registration period for the FY 2025 H-1B cap opens on March 6, 2024, and closes on March 22, 2024.
USCIS launches organizational accounts on Feb. 28, 2024, allowing collaboration on H-1B registrations and petitions. The online filing for Form I-129 and associated Form I-907 for non-cap H-1B petitions starts on Feb. 28, 2024. USCIS accepts online filing for H-1B cap petitions and associated Forms I-907 from April 1, 2024.
Petitioners have the option of paper filing, but linking paper-filed forms to online accounts is not available initially. A final rule increases the filing fee for Form I-907, effective Feb. 26, 2024. Incorrect fees on forms postmarked on or after this date will be rejected.
